Federal High Court, Abuja
The Federal High Court in Abuja has directed the Independent National Electoral Commission (INEC) to deregister five political parties, including the African Democratic Congress (ADC). Justice Peter Lifu delivered the judgment in a suit filed by the National Forum of Former Legislators, which argued that the parties failed to meet constitutional performance thresholds.
The affected parties are:
- African Democratic Congress (ADC)
- Action Peoples Party (APP)
- Action Alliance (AA)
- Accord Party (AP)
- Zenith Labour Party (ZLP)
According to the plaintiffs, Section 225A of the 1999 Constitution (as amended), reinforced by the Electoral Act 2022, requires political parties to win at least 25% of votes in a state during a presidential election or secure at least one elective seat at any level of government. The five parties reportedly failed to achieve these benchmarks in the 2023 general elections and subsequent by-elections.
The court held that their continued existence undermines the integrity of Nigeria’s electoral system. It therefore ordered INEC to deregister the parties and restrain them from participating in political activities, including campaigns, rallies, and primaries, unless they comply with constitutional provisions.
This ruling could significantly impact the political landscape ahead of the 2027 elections, particularly for candidates affiliated with the affected parties, including former Vice President Atiku Abubakar.
